The introduction of a 12-month ‘grace period’ is a small win that packs a big punch for the furnishing sector!
Now (or very soon), a 12-month buffer will apply prior to applying for design registration! Having passed through both Houses of Federal Parliament, we’re awaiting the final 2-4 month ratification that formalises an amendment to the Designs Act 2003.
So what does this mean?
Soon, once a new design appears in the public domain (digital, print, or physical), a 12-month protection period will apply PRIOR to commencing the design registration process.
Australia now joins over 100-trading partners that provide initial protection for periods ranging from 6-24 months.
