NEWS – our catchup with IP Australia today confirmed that the proposed changes to the Designs Act (tabled in December) have now passed the Senate and the bill is currently waiting for the House of Representatives to approve.
Once approved it will be approximately 6 months for the new benefits come in effect, most notably, the introduction of a ’12-month grace period’ – we estimate this will be around August/September 2021.

The next phase of the IP Australia review focuses on ‘solutions’, which will start to unfold during Melbourne Design Week, and continue throughout this year.
This process looks at medium to long-term changes to the existing Australian IP system. ‘Blue sky’ concepts floated so far include the potential for mediation vs courts for settling infringements; or, perhaps, be as radical as binning their current process entirely and start again.
